| الوصف: | La Ley de justicia y paz apareció en el año 2005 con el fin de servir como instrumento de justiciatransicional, que sirviera para allanar el camino de la búsqueda de la paz. Sin embargo, laaplicación de una tesis maximalista, según la cual se debía investigar y juzgar todos los casosy a todos los responsables, implicó un colapso de la misma, por lo que la Fiscalía procedió aestablecer criterios de priorización de casos a través de una norma de derecho blando, paracuya expedición carecía de competencia, en ese momento. Al final se propone un test de ductilidadnormativa aplicable a las normas de derecho blando, en aras de denotar no solo la faltade competencia, sino también la invasión de funciones al legislador, por parte de la Fiscalía.AbstractThe justice and peace law was created in 2005 in order to serve as an instrument for transitional justicethat could pave the way to a peaceful search solution. However, the implementation of a maximalistposition whereby all cases must be tried and sentenced, involved a collapse of the same, so the Attorneyproceeded to establish criteria for prioritizing cases through a soft law, for wich expedition lackedcompetence, in that moment.
