Descrição:This article examines the jurisdictional boundaries of the direct procurement exception between public law entities as opposed to the utilization of strategic alliances with private actors. It demonstrates that delegating technical suitability to third parties distorts the essence of public tendering and contravenes the principles of free competition. The study concludes that the validity of such contracts is contingent upon pre-existing expertise and a legal justification that safeguards the integrity of the administrative system.
