Descrizione:The debate about rights for same-sex marriage has increased in its importance lately, even though the Costa Rican’s Sala Constitutional dismissed this idea in 2006. The Costa Rican’s Sala Constitutional also denied, in 2010, the opportunity for same-sex couples to be acknowledged as a “Common Law Union”. This article aims at supporting the reasons why the Costa Rican government has the duty to allow same-sex couples access to marriage. Thus, the International Human Rights Law, the Costa Rican legal system, the solutions given by comparative law (in addition to doctrinal and constitutional debates), the most relevant jurisprudential criteria of the Inter-American Court of Human Rights and the European Court of Human Rights are analyzed in order to highlight the reasons why keeping a viewpoint based on the principles of Human Rights facilitates the recognition of same-sex marriage.
