| Описание: | This research examines the impact of artificial intelligence on the Spanish judicialprocess in light of Article 24 of the Spanish Constitution, which enshrines the fundamental rightto effective judicial protection. It explores both the opportunities that AI brings for improvingefficiency, access to justice and legal coherence, and the risks itposes regarding transparency, procedural equality, reasoning of judicial decisions and judicialindependence.Based on a comparative analysis within the European Union and the emergingregulatory framework, particularly the Artificial Intelligence Act, the study concludes that AIand judicial guarantees can be compatible as long as technology is implemented underprinciples of legal safeguard, human oversight and institutional accountability |
