| Descripción: | Indicator systems in terms of economic, social and cultural rights have been a rapid advance in recent times, within the United Nations Organization. The justiciability of these rights, has faced serious problems due to the fact thatthe second article of the International Covenant on Economic, Social and Cultural Rights, states that this one depends for its implementation on aspects such as available resources of the State, the progressivity in the implementation of policies, etc. Therefore, an obligatory or mandatory status has not been assigned to such duties, a situation that accounts for the non validity in terms of their real implementation This is why this essay intends to demonstrate how this very same previous concept has been reversed and how it becomes possible, through the systems of indicators developed for different rights,to make available through specific State actions some minimum benefits which may meet the demands of a more general nature. |
