Περιγραφή:In this article, in the first section, the origin and conceptualization of double conformity in the Costa Rican criminal process are discussed. It is based on the premise that resolutions N° 2014-013820 and N° 2014-17411 of the Constitutional Chamber and the subsequent resolutions issued by said Court, even until recently, contributed to the disparity of jurisprudential criteria in Costa Rica in relation to the application of article 466 bis of the Criminal Procedure Code. This is evidenced by having studied multiple resolutions of the Criminal Sentence Appeal Courts and the Criminal Cassation Chamber of the Supreme Court of Justice in the period 2014-2020. Finally, based on the current model of appeals in the criminal process, and due to the large number of positions in jurisprudence, a series of questions are raised -as an orienting guide- with the aim that this issue can be viewed with greater clarity in search of legislative reforms that generate greater legal certainty.
