THE IMPLICIT PACT OF MODERNITY: THE “SEXUAL-RACIAL CONTRACT” AND THE RECONFIGURATION OF DEMOCRATIC CITIZENSHIP IN THE 21ST CENTURY

その他の書誌記述:This article examines the fiction of the classical social contract and proposes replacing it with a more precise analytical category, termed here the "sexual-racial contract," in which Carole Pateman's Sexual Contract, Charles Mills's Racial Contract, and María Lugones's coloniality of gender converge. It proceeds from the premise that Enlightenment abstract citizenship did not suffer accidental deviations in its historical application, but was ontologically constituted through the systematic exclusion of the non-white subject and of women across both the Global North and the Global South. Such exclusion, therefore, cannot be read as a correctable defect of democratic liberalism, but rather as the structural mechanism that has sustained its institutional architecture since its inception. To sustain this thesis, the article articulates the aforementioned tripartite framework with Kimberlé Crenshaw's intersectional critique and with Yuderkys Espinosa Miñoso's decolonial synthesis, contrasting it with three contemporary sociolegal mechanisms verifiable through comparative political science: the necropolitical border regime, the racial and gendered stratification of care work, and institutional insularity toward migrant and racialized populations. Building on this empirical anchor, the article examines the normative implications of this diagnosis for democratic theory, asking whether overcoming the contemporary crisis of representation requires a gradual extension of rights within the inherited contractualist framework or, rather, its conceptual dismantling in favor of a model of citizenship grounded in interdependence and in the substantive recognition of colonial difference. To this end, the article adopts an intersectional political-philosophy approach that integrates decolonial critical theory with the comparative sociolegal study of contemporary migration regimes.
