Disgrifiad:The pro persona principle and hermeneutic criterion is highly complex and abstract, which explains the difficulty of its application within national legal systems. This article identifies some elements that shape pro persona within international law, legal doctrine, and the Colombian legal system, with the aim of facilitating its application in the initial stage of the land restitution process. It is observed that the absence of this approach may be violating some rights of the victims, such as access to justice and an effective remedy, the right to reparation, and the right to property, within the framework of a transitional justice process seeking to overcome a stage of massive human rights violations arising from land dispossession and abandonment.
