Descrição:This essay presents an analysis of the constitutionality filtering carried out by the Constitutional Chamber of the Supreme Court during its almost 30 years of existence to the Labor Code (LC), which dates back 75 years. In spite of the Labor Procedural Reform, which modified this Code in more than one half, its individual substantive part still remains intact. Hence, it is very important to know its future course as marked by said jurisdictional body since its judgments are binding for all citizens. For this purpose, this paper analyzes the judgments (approximately 30) provided by the Center of Jurisprudence of the Constitutional Chamber of the Supreme Court of Justice that have kept several articles of the LC intact in those occasions when they have been challenged of contravening the Constitution of the country, and which have maintained the constitutionality of the regulations under said legal body. Thus, the reader can become aware of the corresponding legal arguments within a framework of legal security and, thus, apply them to professional training and/ or practice.
