Descripción:After a criminal proceeding has been filed, how much time must pass before it can be alleged that the right of access to justice is being affected? Excessive duration of criminal proceedings has implications for all parties to the process, in relation to access to justice; the extinction or injury of the legal situations invoked, due to the passage of time; affecting the principle of freedom, the presumption of innocence and those specific cases related to pretrial detention, in which this precautionary measure is dictated; and for society in general it entails both economic and political implications, which this scientific article aims to analyze.
