Description:In this essay I will analyze the concept “Restorative Justice” and how this notion has regained interest and application in our country over the last decades. In fact, the Code of Criminal Procedure contains elements of crimes that we could qualify as Restorative Justice, such as suspension of proof proceeding, conciliation and full repair of damage. I will also present a brief analysis of the Bill of the Spanish Code of Procedure that is currently under discussion in Spain because it contains some elements related to Restorative Justice, such as proceeding suspension and mediation. Finally, I will provide a comparative analysis of our Code of Criminal Procedure and the Bill of the Spanish Code of Procedure with regard to the concepts of Restorative Justice and the rights of victims and offenders. I hope the essay will provide the reader with important knowledge about Restorative Justice.
