Descrizione:This article examines constitutional rulings issued by Colombia’s Supreme Court of Justice between 1935 and 1945, a period spanning two institutional phases marked by an idealistic and libertarian commitment in both the executive and legislative branches, which methodologically, conceptually, and doctrinally refined the contributions of its predecessors. The jurisprudential movement of the Supreme Court, particularly its creative role until 1940, is often framed as the “Golden Court.” However, did it uphold the conservative constitutional regime of 1886, or did it primarily defend the liberal program of the Republic promoted by Alfonso López Pumarejo? This study addresses this question through a comparative and analytical approach.
