Descripción: | The objective of this essay is to show the strong core concept that characterizes a dogmatic... though juridical being. I propose links among theology, fiction stories and dogma. Also, I propose a number of key distinctions to understand the intellectual nature of the work of the legal-dogmatic analyst. At the same time, I advocate the thesis that the legal dogma must be self-conscious about the kind of knowledge it deals with, and about its intellectual and practical relevance. My main argument recognizes the mostly “normative” nature that characterizes the intellectual dogmatic undertaking. For this, I point out how such nature must be characterized. Additionally, I argue that this nature requires, as a complement, a sound theory of argumentation, a theory of democracy and the support of some kind of plausible ethical objectivism. |
