The Best Interests of the Child as a Guiding Principle of Public Policies in Mexico: Supporting and Directive Functions

Descripción:Since the entry into force of the International Convention on the Rights of the Child, atransformation involving the incorporation of the infantile rights as guiding principles for theformation of public policies was induced, this because the minors´ characteristics or naturalconditions require special protection and also the recognition as right holders, which mustbe a primary consideration , not only in terms of legislation, but also in all measures that aredirectly or indirectly related to them. However, this research highlights the role of the bestinterests of the child as the heterogeneous principle that transcends all areas and authorities, thussurpassing the usual assistance predispositions that make distinctions of public and private law.
