| Descripció: | This paper examines the implications of the criminal record certificate and the right to work among women released from the Mexican penal system. To this end, it presents a synthesis of international, national, and local legal frameworks governing the social and labor reintegration of women who have been deprived of liberty. This synthesis shows how the issue has been addressedwithin the law itself in a “neutral” or “universal” term, without considering gender. The article then offers a brief historical overview of how women’s transgressions have been addressed in Mexico during three periods: the colonial era, the Porfiriato, and the present context. Across these periods, the prevailing stigma emerges as a common element. Finally, the article presents a criticalreview of the concept of stigma and examines how it is manifested in the request for a criminal record certificate, an essential requirement for obtaining employment. This document not only restricts equal opportunities but also violates women’s right to decent work. To address this, public policies that promote the labor reintegration and non-discrimination of women with criminal records seeking to enter the labor market are proposed. |
