The public policy of institutional alternative care in Chile: analysis based on situations of violation of children’s and adolescents’ rights

Descripción: | In the text, we reflect about the possibility that the serious rights violations of children and adolescents who are in alternative care centers because of a determination of a Family Court, could be directly related to the design and the implementation of public policy in this area. Four possible causes of these violations are presented, which were identified from a documentary analysis, among them, the way in which the protection of children’s and adolescents’ human rights has been understood in Chile, the outsourcing of public policy, its implementation, and the delay in the processing of laws related to the protection of children’s and adolescent’s rights. Towards the end of the text, the need for this alternative care policy to be designed and executed from a comprehensive rights protection approach is raised. At the same time, the need to design and strengthen programs to prevent the children´s and adolescents’ rights violation in order to prevent them from being later separated from their families and institutionalized is raised. |
