CURRENT STATE OF THE COMPLIANCE WITH THE MEASURES OF SATISFACTION ORDERED BY THE INTER-AMERICAN COURT OF HUMAN RIGHTS IN THE CONDENATORY JUDGMENTS AGAINST THE COLOMBIAN STATE

Descripción:  The purpose of this article is to evaluate the current status of compliance with the measures of satisfaction ordered by the Inter-American Court in the sentencing against the Colombian State, based on the review of compliance monitoring resolutions. The CIDH enshrines legal actions in favor of people who have been victims of human rights violations, not only seeking the creation of legal instruments for their protection, but also measures to ensure compliance and make sure that what is ordered does not become a challenge but rather a persistent reality within the framework of the international law of Human Rights. Through a rigorous jurisprudential, doctrinal and statistical analysis, the degree of individual and global compliance of all the measures of satisfaction ordered by the Inter-American Court of Human Rights against the Colombian State is evaluated: 1) recognition of international responsibility, 2) investigation of the facts and punishment for those responsible, 3) truth, 4) search for missing people and delivering of mortal remains, 5) publication and dissemination of sentences and educational and training measures for victims, 7) creation of monuments, busts and plates, 8) production and dissemination of documentary audiovisuals. This legal research with a level of evaluative depth constitutes a valuable contribution to Human Rights by presenting a detailed study of each of the measures of satisfaction. It is concluded that the degree of compliance of the satisfaction measures is 48%, which generates a great problem since the default rate is only lower by a margin of 6%, there are measures where compliance even ranges from 0% to 8%.
