Comparative analysis of new comprehensive legislation on human trafficking in Spain

Descripción:In November 2022, the Spanish government approved new legislation on human trafficking to combat the trafficking of persons. The intention behind this new law is to address the problem in a more comprehensive manner, at multiple levels, and through various government bodies. The objective of this article is to evaluate this new measure according to the standards of similar laws, compare it with the previous legislation to assess if it represents an improvement, and analyze its impact on the victims. To achieve this, relevant literature from scientific publications, news articles, and reports from non-governmental organizations about the previous legislation, the new legislation, and standard human trafficking legislation from experts were collected. The main outcome of this analysis is that this law differs from past measures in that the previous ones focused exclusively on sexual exploitation, while this one recognizes other types of victims and victimization and implements measures that facilitate the connection between the victim and assistance methods. In conclusion, it is understood that although this legislation is more comprehensive, its effectiveness depends on the quality of implementation, particularly in terms of the ability of multiple government bodies to truly act in a coordinated and efficient manner to assist the victims. The divisions in intervention actions among these bodies could pose points of danger for revictimization, which will be observed over time and experience, and adjustments may need to be made based on the implementation process.
