Human trafficking law and the prosecution of pimping in Uruguay

Miêu tả:This article explores whether the sociological figure of the procurer, as an exploiter of others' prostitution, is undergoing a change in its criminal configuration since the emergence of Law 19 643 on the prevention and combating of human trafficking. The reasons for this potential change are related to a broader operational definition of trafficking compared to the Palermo Protocol, a precise legal definition of sexual exploitation, and a more updated and comprehensive approach to the rights of victims. These factors, taken together, may begin to be considered by judicial operators in addressing these punishable behavior. To answer the research question posed in the initial paragraph, an analysis methodology of final judgments with the application of both laws for the period 2019-2022 is employed. By investigating three different judicial sources, five final judgments were obtained. The conclusion highlights the coexistence of both laws in prosecuting procurers and traffickers, and even the use of the criminal offense of procuring in conjunction with the criminal offense of human trafficking in the form of sexual exploitation.
