Femicide in the Context of Human Trafficking in the Republic of Argentina

Diğer Bilgiler:Trafficking in persons for the purpose of sexual exploitation is one of the most complex manifestations of violence against women, due to the confluence of physical, psychological, sexual, and economic violence and its connection with other crimes that violate freedom and life. Criminal organizations traffic in the life and dignity of people, subjecting them to a modern form of slavery, a situation that profoundly affects women in the enjoyment of their rights and the possibility of a free life. Questions are raised about the adequate protection of the rights of victims in contemporary society, in the face of the permanent appearance of new groups and their operational modalities. One of these questions consists of determining whether the figure of femicide is applicable to homicide committed in the context of Human Trafficking, since the Argentine Penal Code only contemplates intimate femicide. With the aim of clearing up these concerns, conclusions will be formulated that favor the review of the negative aspects that the current regulations present, as well as the foundations will be provided, in order to encourage future legislative reforms that address this modality of Trafficking in its entirety. For this, a qualitative analysis of the regulations of the Argentine Republic, the treaties signed CEDAW, Belém do Pará and precedents of the Inter-American Court will be carried out.
