Descripción:The Costa Rican constitutional doctrine and jurisprudence conceptualize architectural heritage as part of the fundamental right to a healthy and ecologically balanced environment. Based on the idea of protecting the scenic beauty covers, and consequently, the natural beauty (“the green”) and urban beauty (“the gray”), the environmental principles apply to the declaration and control of architectural heritage. Act 7555 provides the competence of the Central Administration for such declaration and control; however, the regulations of other laws allow the argument that local government –municipalities– can perform such activities, thus expanding the recognition of municipal autonomy in the field the real estate system.
