Descripción: | This paper deals with ten argumentation elements used to assert that it is NOT theoretically admissible to draw attention on multiple rhetorical uses of the term “rationality”. These arguments relate to an academic opinion invoking indisputable professorial correctness (an intraacademic file of doctrinal nature analogous to “political correctness”) in current Theory of Law. The ideas supported in said document are validated as irrefutable theoretical bases, and their unquestionable nature would be demonstrated precisely by those arguments. Thus, the rebuttal of realistic studies on numerous rhetorical uses of said term, effectively used by judges quite often, would be clearly demonstrated. This analysis, on the contrary, reveals the main fallacies of the ignoratio elenchi modes of the “logical’ structures” on which the aforementioned ten arguments are based correspondingly. |
