Structural discrimination and gender parity in the Faculty of Law Assembly at the University of Costa Rica: an analysis of the 2025 electoral roll

| Deskribapena: | This article examines the gender composition of the Faculty of Law Assembly at the University of Costa Rica (UCR) in 2025 as a case study for identifying patterns of structural discrimination within an academic decision-making body, with implications for legal education and the production of legal knowledge. Its objective is to analyze this composition using gender mathematics as a descriptive methodology, interpret its implications from the standpoint of substantive equality, and formulate recommendations aimed at achieving parity. The theoretical approach is feminist, drawing on Pateman’s concept of the sexual contract, Fraser’s participatory parity, and the principle of substantive equality in accordance with the standards of the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW). The study follows a descriptive design with a mixed empirical-legal approach: gender mathematics is applied to secondary institutional data classified according to names socially associated with gender and academic category. The findings reveal a structural pattern consistent with a glass-ceiling effect: names socially associated with men are progressively concentrated in the upper ranks, while those associated with women predominate at the entry levels. The article concludes that this distribution constitutes structural discrimination and that the adoption of affirmative action measures is an enforceable legal obligation. |
