Typification of the crime of human trafficking in Central America, Mexico, and Spain

Descripción: | This research presents an innovative proposal by conducting a comparative law study on the criminal type of trafficking in persons incorporated in Spanish-speaking Central American legislations, in addition to Mexico and Spain, as Hispanic referents in North America and Europe, in light of the Palermo Protocol. The main objective is to highlight the differences and similarities with respect to the legislations of Costa Rica, Panama, Nicaragua, Honduras, El Salvador, Guatemala, Mexico, and Spain, which may represent successes for the prosecution and punishment of the crime. The study is approached from a descriptive and comparative legal point of view, with a focus on international law, based mainly on the hierarchical superiority of international instruments with respect to international obligations. In this way, the analysis is based on the Concept of Trafficking in Persons provided by the Palermo Protocol and compares the elements that constitute the crime in each of the criminal definitions of each country included in this study, identifying differences and similarities. The main result is that the countries under study generally comply with the requirements of the Palermo Protocol. However, several elements present in other legislations could be included to strengthen the criminal type they currently have, both in terms of the actions or verbs typified, as well as in terms of the wording of the means of commission and the purposes included. |
